Ford taking advantage of me? They want to refund my warranty... I need some advice.

Hey guys, I have a situation here that's been troubling me quite a bit.

I bought a used 2003 Ford Focus SVT back in March 07 - 30,000 miles. I bought with it a 2 year plan Premium warranty. The 2 year warranty is what basically sealed the deal for me.

Okay, well here's the current situation. I brought in my car today to the dealership's service department because occasionally it will take a few tries to crank my car... also the engine light came on. They say it needs a new Starter and a new O2? Oxygen sensor (what is this anyways?). Estimated to cost almost $700 total to replace them. I'm like cool well my premium warranty will cover this and I'll just have to pay the deductible ($100). Well the lady says their is an issue with my warranty... that it was never put into the system and only shows the previous owner's expired warranty. So before she orders the parts she was going to check into my warranty to see what the problem is.

I don't hear back for a while so I call them and ask if I can pick up my car and bring it back in once the warranty issue is fixed and the parts are in... which was fine. I go to pick it up and the owner/used sales manager wants to talk with me. He takes me in an office and this is what I'm told...

Ford won't put a warranty on the car because somehow the previous owner voided any chance of there being another warranty it. He tells me they are going to go ahead and order the parts and cover the bill for me AND refund me the $800 I spent for the warranty plan because neither they (the dealership) or I knew that the car couldn't have a warranty. I ask if there is anything I can do about the warranty situation and he says no. So I'm like okay fine... doesn't look like I have much of a choice.

So the current plan is for me to bring my car in next week for service, and this guy is going to cut me a check for $800 in addition to paying for the current repairs.. However, thinking over it now this doesn't seem right at all. Sure I'm being refunded the warranty cost, BUT I'm now stuck with a car w/ no warranty for the next year and a half. What if my transmission goes out... or something worse ($800+ repair) during this time? I'm screwed basically. And honestly, this deal would have never been sealed if it weren't for the 2 year warranty offer.

What do you make of all this?

If it is in your sales agreement, then it sounds like they're stuck. If nothing else, tell them to cancel the whole sale, refund any money, and you will buy elsewhere. Part of your reason for buying this car was the warranty. If they won't work with you, seek legal aid.

Ok the part that is a worry is the "somehow the previous owner voided any chance of there being another warranty it."

The dealer appears to be quite good about it by refunding you the warranty money and paying for repairs but what is the problem with simply purchasing another warranty. What has happend to the car to cause this and if it is that bad then perhaps, as thefonz has said, you may need to say you were sold the car falsely and need to get a refund so you can purchase a warrantable car.

Maybe you are able to simply purchase another warranty for $800.00 if it is only a technical error that voided the previous one.

thats what i was thinking... modifications are a sure way to void a warranty, and a reason for them to not allow another one to be purchased.

The O2 Sensor. This Takes The Harmful Pollutants That Your Engine Makes Out Of What Is Coming Out Of The Exhaust. Its Tricky To Explain. Basically Without It, Anyone That Stands Behind Your Car Could Get Seriously Sick Or Die.

ok... that is totally untrue. what an oxygen sensor does is it reads how much oxygen is left in the exhaust, and in turn tells the computer... the computer interprets this information and tells the injectors to put either more or less fuel into the cylinders. if theres too much oxygen left then it puts more fuel in because its running lean... if theres too little oxygen then it cuts the amount of fuel injected because its running rich... a properly running car will constantly switch from lean to rich and back to lean about 20 times a second. when an oxygen sensor goes bad it will run constantly rich- and your mileage goes down and it will eventually burn out your catalytic converter. the catalytic converter burns the hydrocarbons (unburned fuel) and the nitrous oxide that the engine puts out before it goes into the air.

Let's get this straight:

1) The USED car you just bought threw a Check Engine Light.
2) The dealer estimated the cost to be $700 to repair it.
3) The USED car cannot be warranteed due to the previous owner voided any chance the vehicle can be warranteed.
4) The Used Car Dealership (who really, really cares about you) is willing to get hosed for $700 and refund the "Rip-Off" $800 premium warranty (that consumer groups like Consumer Reports tells people not to buy because it's a sucker's bet).
5) You are now lucky enough to have the Reset button pressed for your potential disaster on their dime. Since the contract stated that the warranty is part of your deal, you can just return the car and get ALL OF YOUR Money back.
6) Why are you not doing this?

Just my $0.02.

I like warranties on used cars that I buy. But you have owned this car. How many miles have you driven it? Isn't it a pretty reliable car? The dealer has taken it on the chin for you, or at least offered to. Why would you want to loose this car and jump into another unknown? I sure wouldn't. I'd take the money back, take the repair and go pay down the car loan. Or bank it in the savings for a rainy day repair should that pop up. I wish the dealership offered the warranty money back on my last three cars. I never used the warranty on one. Used only about half on the other. And the pickup maybe about one third of the money invested in the warranty was used. All before the warranties expired. Take the money. They are doing you a favor.
