The answer to all this is real simple. Government stays out of marriage. If you partner with someone, you get a civil union that defines what happens at separation. make it so that only a recognized church can marry. Church can say no if they want and the couple looks for another place to get married. If the couple chooses to marry without a civil union, neither has rights to anything under the law, i.e., insurance, next of kin etc. That way the government stays out of the churches doing and vice versa.
