Just wondering wether or not it is illegal to be drinking while drive but being under the limit.
I have 2 different views on this the first being that it could be legal because you can still drink without being over the limit.
The second is that it may be illegal because it is a distraction (like mobile phones)
Does any one have any opinions on this or know what the actual law regarding it is?

I don't know about SA, but I heard somewhere that in Vic it's actually illegal to have open bottles/cans of alcohol in a moving vehicle. If I'm wrong, let me know!

thanks, i don't think it would be illegal here as we have s\-|it all road rules lol... in about everystate of america it is illegal to have an open bottle/can in car isnt it? even for passengers

playing with fire even if you've only had a couple of beers.....don't think your insurance company will look too favourably if your involved in an accident.....whether it's your fault or not

the driver cannot be drinking alchol or be under the influence whilst driving. but passengers can drink till their hearts are content.
also going on U.S law i remember seeing an episode of Backberner a few years ago and they were in some county in texas talking to the local cop about some laws in that particular place. the 2 i remember the most were:
1, it is LEGAL to have a six pack (alcohol) sitting next to the driver while he is driving and the cans are allowed to be open BUT if he wanted to drink one he'd have to pull over first.
2, it is ILLEGAL not to have a loaded HANDGUN in the car for the drivers protection. (the crime is really bad and car jackings and shootings are really bad there...go figure....but road rage is non existant)
i spose, this is all from a state that believes in execution of criminals.

I tought any drinking/eating while in control of a vehcle is illegal, as in actual fact you are supposed to have 2 hands on the wheel at all times to be in complete control of a vehicle unless changing gears, indicating etc, of course.

thats a load of BS. your sposed to do this but its not illegal not to. cops dont do this, they dont enforce this and i have never ever heard of anyone ever being fined for it.
FFS if its illegal not to have both hands on the wheel then how the hell are you sposed to stick your finger up at inconsiderate motorists?
