frown Need help getting my licence back...

Well Its been just over 4 months without it, heres what happend...

It all started one arvo when my mate came around (in his XF) and we where going to go have a look at my Xf I was building http://www.wn.com.au/rcpark2/Ford/XFpaint2.htm (nice plug)
we decided 2 take my mums VN commonwhore that I had at my house since my EA had a rooted tranny. I backed out of the drive way, while he was shifting his car (only me in the car) did a roll back and left a lil black mark, one wheeler 4 about 50 metres (going very slow at the time) I then came back 2 the house picked up my mate after he also did a tiny burnout. we went 2 the top of the road and sat at an intersection, made sure no-one was around and everything was safe. Started with a stand still then went down the road back 2 my house (at a very slow speed)

We then went inside, about 10 minutes later we went 2 leave the house in his car when an undercover cop car pulled up and then a marked car.
they questioned us and I took the blame 4 the lot after the threatend to tow the cars away, I was arrested and taken 2 the cop shop, video interviewed, finger printed and had DNA samples taken.

4 days later I went 2 court, had my licence taken away for 12 months and $900 in fines.
Now before you start saying, "haha deserves you right bitch!" I know I did wrong but I think it is very harsh, 6months would have been fair,

Comparing it to another friend in an unlicenced XF did donuts in an intersection, cut up everywhere, video taped it and got arrested and only lost his for 6months (with someone else in the car and a previous record)
Another story is a guy with his L's, stole a car when he was drunk, crashed it and only lost it 4 a year.
I wanna know why I was treated pretty harsh, I was been very carful at the time and was going slow and was out of town, I wasnt endangering anyone but myself.
Also the police yellow stickered my mums VN, but at the time was park in the carport on private property.
and....last but not least part of the fine was $300 to clean up the marks, more than 4 months has past and no-one has touched them.
(and its only a small town, Albany W.A)

I just wanna know If I can write a letter or somthing and get it reduced?
what does everyone think? (and yes I know Im in the wrong and I have learnt my leason)

You should have just denied it all.
If no one had you on tape, how where they going to prove it? Anyway, as long as you've learned your lesson

I find it strange that they took DNA samples?

Re: Need help getting my licence back...

oh right I forgot 2 say they said they had 6 people ring them up, which is probably a lie and was only one person.
Suprised they didnt tell me an "off duty police officer seen me" they always seem 2 tell me that.

yeah I think if you get arrested they take a sample, the police where acctualy prett nice about it and joked around, also he complimented me on the second one burnout.
the Judge on the other hand, well I was one of the last cases and he had just had a lot of "indigenous" people in there before me been smart arses.

Yeah it was a bloody stupid thing to do, but the punishment was harsh. With this sort of crime, it all depends on the judge you get. Get a good one, and you might just get a fine. You obviously just got a harsh judge. I am not completely sure, but you may be able to appeal the decision on the grounds that it has severely impacted your life/work. Talk to a lawyer and see what they can suggest. The only problem with appealing, is that if you do get your license back, they will give you an even larger fine.

Re: Need help getting my licence back...

punishment is way harsh. That's just crap man.
Jezzus so you did a burnout and they treat you like a hardened criminal and take your prints and DNA?
SCUM! Ever since sep11 We've had to sit back while our civil liberties are taken away for "our protection!" Shit's me to tears.
Well you were doing the wrong thing but I would have thought you'd get off for pleading guilty. (The ****ING SCUM THAT STOLE MY CAR GOT NOTHING CAUSE THEY PLEADED GUILTY! AHHHHHH!!!!)
Here is a tip. If you are EVER scheduled for an arvo session in court ask for an extention and then claim work requirements require an early appearance this will get the judge in a good mood.
You must have pissed someone off or looked like a little punk infront of the judge for them to be that harsh.
I guess you could apply to the courts for an appeal or reduced sentance but you'd have to have a reason for it.
You could arrange to front up to court and simply explain that not having your licence his hindering your ability to obtain decent employment or something.
You do have rights and can ask a judge to reevaulate your case at any time.
Best thing to do is see a lawyer should only cost about $50 for an interview to get things rolling.
Get a lawyers advise but don't take one to court with you it would cost a packet and it's not something you need for such a minor offence.
I seam to get away with blue murder cause I'm an innocent smart looking little bugger.
Hope that helps man.

Re: Need help getting my licence back...

They can't yellow sticker a car onprivate property.
If they tell you they can, that's total bullshit; they tried to do it to our truck driver = 50 years old. He told them he'd take it to court and they backed off in a hurry. So fight that one man!

Oh yes naughty naughty

Re: Need help getting my licence back...

Legal definition of 'Justice"

'The upholding of rights, and the punishment of wrongs, by the law'

Me thinks you got too much of one, and not enough of the other.

Engineers aren't civil because they have to defend their designs to the mechanics!
