frown My car might be written off, what can I do?

As some of you may be aware, I was involved in an accident in my XR6 last week on the way to help out Dellboy999. Since the accident the car has been sitting at Mack Motor Body Repairs, but unknown to me until yesterday was the fact that no work has been started on it.
So I went there yesterday to get some stuff out of the car and the manager told me that they were waiting for the go ahead. I asked him why and he said that the car had been valued at $7000 and that the value of the work required on it was somewhere in the vicinity of $4800.

Now apparently RACV has a policy, which states that if the work required on the car exceeds 70% of the market value of the car, then it is deemed to be a total loss - and this is the reason for the delay as it is so close to the mark.
As you can probably imagine I am a little upset over this, as I won't find out until Tuesday what is going to happen. I am also upset because when I bought the car 2 months ago and took out the policy, I was told that the market value of my car was $9000 - $9900. The car had only done 140,000 kms and was in absolutely pristine condition, so I really don't want it to be written off.

If it does though, what avenues of appeal do I have? Some people might want the money, but I am not one of them, I loved that car, worked hard to save up for it, and only had it for 2 months before some idiot decided to turn in front of me. In short I just want it back the way it was before the accident, which is the reason I took out fully comprehensive insurance.
Any advice on the subject would be greatly appreciated.

well the said price is under 70%, so u may be ok. but only just.
I'm fairly suprised that it is only valued at $7k, has it been assessed?

well i have always been of the opinion, if it wasnt your fault the other person should fix it or buy a new one for u, im not sure what your options are really, if you were in queensland i would gladly donate my services to get the panel damage fix :) im not am panel beater, but im willing to help mate

I was in this very situation at the start of the year, my car also came close to being written off, but because the motor itself was not damaged - that was the deciding factor in my case.

As for 'appealing' the insurers decision, check in your policy first, as there may be a clause that states their decision is final. If thats the case, you're just gonna have to wear it. However if that doesnt appear anywhere, you may be able to ask to have an assessor come out and look at it. I know with NRMA, when they 'assessed' my car, that was simply someone in an office looking at a lot of digital camera pics that the smash repairers took. If this is what they've done for you (and it is the usual way of doing it), you can ask for them to have an assessor actually look at it in person, at your expense of course.

My policy also worked on an agreed value, not market value, so I was lucky in that sense. Had market value come into play it probably would have been deemed acceptable loss. By the sounds of it your policy is not going onagree value?

I think your best bet is to do as I mentioned above, failing that I don't know what else you could actually do. But here's hoping you get your car back repaired, as going by the pics it was one hell of a nice car.

mate, get the assesors number through hell or high water and complain. that assesment is bullshit. they tried to value my straight as a pin EA at $2000, i told them to get ****ed. in the end they valued it at $4000. its worth a phone call. be prepared, have photos of the car and ads to state other XRs of the same model at much higher prices (get on the internet and look some up). list all the good points of the car (low km, straight panels, perfect paint, immac interior). dont let those pricks get away with it.

as you can tell, i hate insurance companies...

Thanks for all the advice and offers of help from all you guys. I guess I will try and get hold of the assessors number and hassle them into fixing my car as I really don't want the annoyance of a write off after only owning it for 2 months. And if worst comes to worst, I will just buy the wreck off them and fix it myself as I am sure that the quote may be a little inflated because they know it is insurance work.

I will keep you guys posted and thanks again.

Going by the redbook prices things don't seem too good for it..

average kms 170,000 - 210,000
trade in price guide* $3,000 - $4,200
national average price - private sale* $4,000 - $5,900

add maybe a $1000 for the low kays and thats still only $5200.

Couldnt you get the panel beaters to lower the price for the insurance company and pay the rest on the side so like that the insurance want know.
