I hate to say this but this is why I never buy a first model year vehicle. Wait til the second year so that most of the original problems found will be fixed or at least known to dealers. Anyway, I'd take it to another dealer as TBird mentioned above. A second if not a third opinion is good to get. Ford's auto's are built for fuel economy and will upshift as soon as humanly possible. I believe this is why Ford didn't want to put a manual shift option on the 6 speed automatics. Cost is just their excuse not to add the option.
All Ford needs to do is to build a new software program for the transmission. By the sounds of it the current one doesn't seem to be working. If they're investigating a fox then they're not refusing to fix the problem, they're just prolonging it. It would aggravate me more that the cars reliability just went out the window until a solution can be found. A simple transmission fluid change may help, but I'm sure Ford will want you to pay for it.
Is anyone else having problems with their Ford Five Hundred transmission?? I just found out that I need a new transmission in mine and it only has 55,000 miles on it. Unfortunately, the first year these were made, the warranty was only 3 years, 36,000 miles, so I don't have a warranty and there is no recall on it. According to Ford, I'm out of luck and will have to pay for it out of pocket to be replaced. Anyone else having these issues??
Same car, same transmission problem, same warranty problem. I've been a loyal Ford customer for a long time so, needless to say, I am displeased with Ford's response.

This is the website for the National Highway Traffic Safety Administration. If more people log a complaint, they will begin an investigation and put pressure on Ford to recall the transmissions.
Can the CVT change to the 6 speed for ford 500? I am pretty sure all cvt are going to have the same problem. after 40 k miles. Any mechanic
can advise our unlucky 500 cvt owners?
If the bellhousing is the same then it's doable with not much cost. I'd wait until you put more miles on the CVT before spending the $3K or so for the 6 speed trans. If you have AWD you'd have to contact a dealer to see if the swap would require any changed AWD parts. Chances are slim that you will, but better to be certain. Start checking local salvage yards out while you wait, since there will be some low mileage wrecks that you can take advantage of when they roll in. Interesting how you mentioned that, as I had a '08 Taurus as a loaner for a few days a couple months back, and the right front suspension made some strange sounds, and it only had 3800kms on it. I imagine a previous driver drove over something they shouldn't have...perhaps there is more; ie. Ford issued the wrong torque specs at the factory when they installed the parts!
